Adds definitions for "health care professional" and "expedited partner therapy". Provides that the Department of Public Health shall provide information and technical assistance as appropriate to health care professionals who provide expedited partner therapy services for persons with sexually transmissible diseases. Provides that a health care professional who makes a clinical diagnosis of chlamydia or gonorrhea may prescribe, dispense, furnish, or otherwise provide prescription antibiotic drugs to the infected person's sexual partner or partners without physical examination of the partner or partners, if in the judgment of the health care professional, the partner is unlikely or unable to present for comprehensive health care. Provides that the health care professional shall provide counseling for the patient and written materials to be given by the patient to the partner or partners. Provides that a health care professional providing expedited partner therapy in good faith without fee or compensation and providing counseling and written materials shall not be subject to civil or professional liability, except for willful and wanton misconduct. Provides immunity from civil and professional liability to pharmacies and pharmacists who refuse to fill prescriptions for this program that would cause the Pharmacy Practice Act to be violated. Provides that no health care institution, or any employee, staff person, contractor, or other person under the direction or supervision of a health care institution, may discharge, dispose of, flush, pour, or empty any unused medication into a public wastewater collection system or a septic system. Defines "unused medication" as “unopened, expired, or excess medication that has been dispensed for patient or resident care and that is in solid form. The term includes pills, tablets, capsules, and caplets.” Unused medication does not include any Schedule II controlled substance under federal law in any form and medications contained in intravenous fluids, syringes, or transdermal patches. Requires a health care professional prescribing an opioid antidote to a patient to ensure that the patient receives certain patient information; provides for immunity from disciplinary or other adverse administrative action; and provides for administration of an opioid antidote in an emergency. Requires the Director of the Division of Alcoholism and Substance Abuse, in consultation with statewide organizations, to develop and disseminate to health care professionals, community-based organizations, substance abuse programs, and other organizations training materials in video, electronic, or other formats to facilitate the provision of the required patient information. – Neutral
HB1014 – Rep. In the Illinois Controlled Substances Act, sets forth guidelines for the prescriptive authority delegated to advanced practice nurses as it relates to certain controlled substances, including Schedule II controlled substances. In the Nurse Practice Act, provides for the licensure of a registered professional nurse as a certified registered nurse anesthetist who does not have the required graduate degree, provided that he or she meets certain other requirements. Provides for the licensure of an advanced practice nurse as a certified registered nurse anesthetist who does not have the required graduate degree, provided that he or she applies for licensure before July 1, 2018, and submits certain information to the Department required for licensure. HB1293 – Rep. Angelo Saviano - Passed both Senate and House awaiting Governor's signature – Amends the Pharmacy Practice Act. Replaces "pharmacy intern" with "student pharmacist". Provides that any person may apply and successfully register with the Department as a student pharmacist if he or she provides proof that he or she is actively enrolled in a course of study for his or her first professional degree in pharmacy at an ACPE accredited college of pharmacy and has not engaged in conduct or behavior determined to be grounds for discipline under this Act. Also allows foreign pharmacy graduates to use the “student pharmacist” title while completing their 1,200 hours of clinical instruction required prior to sitting for NABPLEX. Provides that once a student pharmacist receives his or her certificate of registration from the Department, he or she may, under the supervision of a licensed pharmacist, assist in the practice of pharmacy and perform any and all functions delegated to him or her by the pharmacist. HB2247 – Rep. Angelo Saviano - Passed both Senate and House awaiting Governor's signature – Amends the Physician Assistant Practice Act of 1987. Provides that a physician assistant may prescribe, dispense, and administer drugs and medical devices to the extent delegated by the supervising physician, including the prescribing and dispensing of Schedule II through V controlled substances as described in Article II of the Illinois Controlled Substances Act and all legend drugs (now, limited prescriptive authority may be delegated by a physician for Schedule III, IV, and V controlled substances in written guidelines to a physician assistant). Provides that dispensing activities of any physician assistant shall comply with appropriate federal and State regulations and occur when pharmacy services are not reasonably available, or when it is in the best interest of the patient, or when it is an emergency. Provides that physician assistants may request, receive, and sign for professional samples and may distribute professional samples to patients. Amends the Controlled Substances Act. Provides that the Department of Financial and Professional Regulation shall register licensed physician assistants and licensed advanced practice nurses to prescribe and dispense Schedule II, III, IV, or V controlled substances (now, III, IV or V controlled substances).
